One of the key issues (if not the key issue) in contracts is the limitation of a vendor's liability.  While there are limitation of liability clauses, there are other issues as well such as service levels and rebates, indemnities, contractual risk such as the Fair Trading Act and the Consumer Guarantees Act, international risk, and so on. 

We have updated and presented this paper at seminars several times, which was first presented to the New Zealand Computer Society and the Technology Law Society in 2002.  Our latest paper was produced in 2005.
